COQUI COQUI SPA SA DE CV also owns all trademarks, service marks, trade names, logos and domain names used on or in connection with the Sites or has a valid right from a third party to use any such material. Any modification or use of the materials from the Sites for any purpose not explicitly permitted is a violation of Coqui Coqui’s copyright and other proprietary rights.

No part of the Sites may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any manner whatsoever, except for viewing purposes, without the prior written consent of Coqui Coqui US. This prohibition also includes framing any content from the Sites, as well as unauthorized linking.

7. TERMS and CONDITIONS of USE

These terms and conditions of use (hereafter called T&C’s) as well as our Privacy Policy and our Legal Notice apply to this Website , selling products from the Coqui Coqui brand, destined to be delivered in the United States of America or in Canada, excluding Postal boxes (hereafter called « the Territory »).

Any order on this Website means complete acceptance of the present T&Cs by the Customer buying a product (hereafter called the Customer). These T&Cs can be saved and/or printed and are available from every page on this Website. These T&Cs may be modified at any time without notice. The T&Cs that apply are the ones implicitly accepted by the Customer at the time that he or she places an order.

1.2. Coqui Coqui US

This Website www.CoquiCoquiUS.com containing Coqui Coqui’s online boutique is published by KVDAR Inc, with its registered office at 1902 Seventh Avenue, New York, NY 10026.

1.3. THE CUSTOMER

This Website sells Products to non-professional clients, aged 18 and more and of complete legal capacity. Such sales are for personal use only.

The use of Coqui Coqui’s online Boutique is forbidden to minors and KVDAR does not ask its Customers for their age or birth date, nor for any personal information from minors. KVDAR cannot be held responsible if a minor buys a product from this Website without supervision or authorization.

1.4. PRODUCTS

Products displayed on Coqui Coqui’s online Boutique are described as precisely as possible (availability, specifications, illustrations, size, composition etc.). However, KVDAR does not guarantee that these descriptions are entirely exact, especially concerning availability. KVDAR may change, correct or update these descriptions at any moment without notice.

1.5. PRICES

The prices that apply are those displayed on the page where the Customer can confirm his order. These prices are subject to change. The Customer should pay close attention to the prices when ordering. These prices are shown when a product is added to the shopping cart.

Prices are displayed in US dollars ($USD), tax excluded. They do not take into account the shipping costs of the order (Shipping Costs). The Shipping Costs will be shown to the Customer on the page summing up the order, before confirmation and payment of the order.

2. ONLINE ORDER

2.1. ORDERING THE PRODUCTS

The Customer must choose the products and place them in the shopping cart. At any moment, the Customer can remove products from the shopping cart, using the icon ‘Shopping cart’ in the right hand corner of the page.

Using this same button, the Customer must verify the order. At this stage of the order, the Customer can check the order and correct any errors.

On this page, the Customer can also estimate the order’s shipping costs by indicating the country and state of delivery.

The Customer must then click on ‘Proceed to checkout’. The Customer can then check-out as a Guest or sign into his or her account and pay.

If it is the Customer’s first order, he or she will have the possibility to create an account by filling in a registration form. Coqui Coqui US cannot be held responsible if the information filled in by the Customer is incorrect. To finalize the order, the Customer must confirm both the shipping address and the billing address.

If the Customer has decided to checkout as a Guest, he or she must also fill in credit card information. If the Customer already has an account with this Website and has logged in to his or her account on this Website, this information will be imported automatically.

Once payment is confirmed, the Customer will immediately receive a confirmation email. The Customer formally accepts that KVDAR will confirm the contents of each order via email.

2.2. PRODUCT AVAILABILITY

The availability of a given product is displayed on the Product page. The Customer has the possibility to ask by email for information on future availabilities. If products ordered are not available, KVDAR will inform the Customer by all means available (telephone and email). Any missing products will not be included in the payment.

2.3. CANCELLING YOUR ORDER

IMPORTANT: Once an order is paid for, it is impossible to cancel the order.
In the case of a dispute, KVDAR may refuse to honor the order until the dispute is resolved.

To protect its Customers against any attempt of electronic fraud, KVDAR reserves the right to refuse to ship orders coming from untraceable email addresses. KVDAR also reserves the right to refuse to ship orders containing non-valid telephone numbers.

3. PAYMENT

Credit cards are the only way to pay an order on this Website. We accept Visa, Mastercard, American Express, Discover, and Google Pay.

KVDAR has put in place a secured payment system for all orders placed on Coqui Coqui US's Online Boutique. The payments are treated on an external platform by a specialised company that enforces 3D Secure measures.

4. SHIPPING AND RECEIVING THE PRODUCTS

4.1. SHIPPING

Coqui Coqui US only delivers its products in the United States of America (P.O. boxes are excluded). Coqui Coqui US delivers through either UPS or FedEx. The Customer will receive his or her order within 30 days maximum after receiving a confirmation email.

An email will inform the Customer of the UPS or FedEx tracking number that will allow him or her to follow the delivery live.

The information regarding shipping modalities is also available on the order’s validation page, as well as on the page summing up the order, before payment.

There will be no order delivered if payment is not complete.

4.2. SHIPPING COSTS

Shipping costs are to be added to the total price of the order.

Shipping costs will be determined from a chart taking into account the country of destination and the mode of delivery.

Please note that we cannot ship any alcohol-based products, including eau de parfum, eau de cologne, mosquito spray, room & linen spray, or reed diffusers by air. By law, such products can only be shipped by ground.

Shipping fees are free of charge on orders $100 or more.

4.3. RETURNING or REPLACING THE PRODUCTS

For any Product Return or Replacement Request, the Customer must first contact Coqui Coqui US’s Customer Service department at coquicoqui@kvdnyc.com within the fourteen (14) days following delivery of the products, stating the Order Date, the Order Number, the Item(s) that the Customer would like to Return or Replace, the Reason for the Return or Replacement Request, plus the Customer’s email address and the Customer’s Phone Number (the best number to reach the Customer on during business hours).

IMPORTANT: No claim after this 14-day limit will be honored.

NOTE: The return shipping costs will be at the Customer’s expense.

4.4. RETURN MODALITIES

IMPORTANT: Only product(s) that are unused, still packed in its original factory-sealed cellophaned packaging, unopened and undamaged can be returned.

KVDAR will not reimburse or exchange Products returned by the Customer that do not correspond to the products originally ordered by that Customer on this Website.

By the same measure, product(s) ordered on this Website CANNOT be returned to any retail store carrying Coqui Coqui products.

We recommend shipping returned merchandise via UPS or FedEx for tracking purposes and to ensure timely delivery. KVDAR will not assume responsibility for reimbursement or compensation in the event that return packages are lost, stolen, or mishandled.

*Please retain your recorded delivery receipt as proof of postage.

All returned goods will be examined upon receipt. Refunds, replacements or exchanges will not be offered on any altered, damaged or used goods. Please allow 30 working days for your refund or replacement to be processed. Refund will be provided in the same method of payment used to make the original purchase. Delivery charges are not refunded. KVDAR reserves the right to refuse refund of any merchandise that does not meet the above requirements.

The return shipping costs are at the Customer’s expense and will not be reimbursed by KVDAR.

4.5. REIMBURSEMENT

KVDAR will reimburse the cost of returned Products that meet our above-stated requirements, using the credit card originally used for to order. Again, NO shipping costs will be refunded.

Any returns that qualify for refund will take place fourteen (14) days following the date of receipt of the returned products.

5. CUSTOMER SERVICES

Products bought from Coqui Coqui US's Online Boutique cannot be exchanged in Coqui Coqui stores or any stores selling Coqui Coqui Products.

6. LIMITATION OF LIABILITY

Coqui Coqui US cannot be held responsible if the contract is not executed correctly due to a case of absolute necessity, the Client’s fault or from an unpredictable and insuperable event resulting from a third party to the contract.

7. GUARANTEE

7.1. NON-CONFORMITY AND HIDDEN DEFECTS

The Customer must verify the conformity of the products received with his or her order. If there is any mistake, the Customer must reach out to Coqui Coqui US’s Customer Service department at coquicoqui@kvdnyc.com within 14 days of receipt.

In the case that the Customer receives faulty product, the Customer will be able to ask for a replacement. Coqui Coqui US will facilitate the replacement after receiving and examining the returned product.

No replacement product will be sent until KVD receives the faulty product and has determined that it qualifies for replacement.

If the exchange is impossible or cannot be put in place within a month after the products’ reception by Coqui Coqui US, the Customer will be able to ask for reimbursement.

7.2. CASES IN WHICH GUARANTEE DOES NOT APPLY

If the Customer returns products that do not correspond to the order or that do not come from Coqui Coqui’s online boutique, KVDAR will not be obliged to comply with the modalities described above.

8. PERSONAL DATA

The Customer has the right to access and correct any information that concerns him or her directly (such as his or her address). To use this right the Customer must contact Coqui Coqui US’s Customer Service department at coquicoqui@kvdnyc.com

9. INTELLECTUAL PROPERTY

KVDAR owns the domain name www.coquicoquiUS.com. The Website is a creation protected by the laws of intellectual property. The entire Site, as well as the products sold on Coqui Coqui’s online Boutique, and all the elements that compose it, such as (but not exclusively) movies, photos, logos, brands, drawings or models, texts, diagrams, software, animations, illustrations are the exclusive property of Coqui Coqui US.

Only Coqui Coqui US is allowed to dispose of the intellectual property rights attached to the Website.

The use of all or part of the Website, through downloads, copies or shares for any other end than private and personal use (commercial or not) is strictly forbidden. Violation of this paragraph exposes the person to the law.

When using the tool « Share » on the Website, you admit and accept that these contents can be shared for purely private and personal reasons. There must be absolutely no commercial means.

The creation of hypertext links redirecting towards the Website can only be done with written and prior authorization from KVDAR. This authorization can be revoked at any time without notice. All websites containing a hypertext link to this Website are not under KVDAR’s control. The Terms and Conditions of Use are subject to U.S. law.
